Podcast Episode 1: the Trial Begins


 In 2006, Dan Gordon, an award-winning screenwriter and producer, was writing the screenplay to a Universal Pictures proposed film based on Lou Eppolito's book, Mafia Cop: The Story Of An Honest Cop Whose Family Was the Mob. When he read in the papers that Louis Eppolito and his partner, Stephen Caracappa, far from being heroes, had been arrested for supposedly selling secrets and becoming hit men for the mob, he asked Universal Studios if he could cover the RICO trial of two NYPD Detectives, Louis Eppolito, and Stephen Caracappa as research and they heartily agreed. During the trial, it became clear that Eppolito did not believe his defense attorneys were acting in his best interests.

The news media dubbed the two NYPD Detectives the "Mafia Cops" and it was a sensational trial that on the surface looked like Eppolito and Caracappa not only took bribes to deliver information to the Lucchese Crime Family but also acted as hitmen for the mob.

The trial hinged on the testimony of a small-time criminal, Burton Kaplan who said he was a go-between ferrying information and payoffs between the two detectives and Anthony "Gaspipe" Casso.

MafiaCopBookThe Mafia Cops trial was surprising in several ways. First, Eppolito's and Caracappa's defense attorneys never called any witnesses to the stand. Second, the prosecuting attorneys admitted that they did hot have any evidence that Eppolito or Caracappa committed murder so they tried the two NYPD detectives under the RICO Act (Racketeer Influenced and Corrupt Organizations Act). And last and most importantly, it was discovered that during the trial the prosecution withheld the fact that a former Federal informant had written two letters to two Assistant US attorneys in which he confessed to at least one of the murders himself and alleged that his real informant was a high-ranking FBI agent and not the defendants. Thus, never hearing Casso's testimony nor being privvy to the letters the jury returned a verdict of Guilty and the detectives were sentenced to life imprisonment without parole.

At least that is the surface story…

Judge Jack Weinstein, we believe, based on his length of time on the bench, was worried about his legacy. We later found out that he had been the Judge in an earlier trial in which it was alleged that a former FBI agent was guilty of crimes eerily similar to those with which the two detectives were now charged; leaking information to a mob boss which led to the murder of his rivals and framing others for those crimes. Furthermore, during the trial, Judge Weinstein would have been privy to the fact that an FBI agent named Chris Favo had wanted to interview Anthony Casso, the same man who had supposedly hired the Mafia Cops. Favo wanted to interview Casso because he believed Casso had evidence that the allegedly corrupt FBI agent was supplying confidential information to the Mob, including to Casso. During that trial, Weinstein had concluded only that the allegedly corrupt FBI agent R. Lindley DeVecchio and the mob boss Gregory Scarpa Sr. had a " troublingly cozy relationship", nothing more. Thus if Casso were called as a witness in the Mafia Cops' Trial and stated that the source of the information he used to murder his rivals was a corrupt FBI agent and not the Mafia Cops, Weinstein's reputation would have been damaged, possibly beyond repair.

We believe it was no coincidence that during the trial of the two detectives, Judge Weinstein stated that he had already determined that Casso and the defendants were co-conspirators during a 20 year period and that anything Casso might say on the stand might well be "in furtherance of that co-conspiracy." In other words, both Casso and the defendants were pre-determined by what was supposed to be an impartial Judge to already be guilty of the co-conspiracy with which the detectives were charged. How then could they possibly be afforded a trial by an impartial Judge as the Constitution mandates?!

Two things occurred simultaneously at the end of the trial which should have raised reasonable doubt in the mind of any jury:

  1. R. Lindley DeVecchio, a former high-ranking FBI agent, was indicted by the Brooklyn District Attorney, on four counts of second-degree murder. It was alleged that he had been working with Gregory Scarpa, Sr. a Captain in the Columbo family and best friend of Anthony " Gaspipe" Casso!
  2. The Prosecution did a huge document dump after withholding important evidence that would have cleared the policemen and opened up a deeper coverup of Department of Justice corruption. As shown in the attached documents, Anthony Casso wrote two letters to the  Assistant U.S. attorneys of the 2nd District of New York, wherein he confessed to the crime of murder and exonerated the detectives. Moreover, he indicated the source of his information was not the two detectives but an FBI agent. These documents were withheld from the jury, as was the transcribed conversation in Judges quarters which totally exonerated the two detectives of any of the crimes with which they were charged and accused the Government of knowingly having covered up the real perpetrator and framing Eppolito and Caracappa.
