At the end of the Mafia Cops trial, two events had simultaneously occurred:

  1. R. Lindley DeVecchio, lead agent for the FBI Colombo Family Crime Squad was accused of assisting in four murders and of allegedly being an informant for Gregory Scarpa, Sr. of the Colombo Crime Family.
  2. The prosecution did a document dump where two letters from Anthony Casso were discovered in which he confessed to the killing of at least one of the mobsters pinned on The Mafia Cops, exonerated them of the rest, and alleged that his crime family informant was a lead agent for the FBI.

Upon discovery of Casso's letters to the U.S. attorneys, Judge Weinstein ordered that the Defense call Anthony Casso and ask if he would testify in court about the contents of his letters. Judge Weinstein said that he had already determined however that Casso and the defendants were part of a co-conspiracy for over 20 years and anything that Casso said on the stand would be in furtherance of that relationship. Thus, Judge Weinstein, in essence, was saying that he'd made a predetermination that Casso was a liar, no matter what he said. In the end, Judge Weinstein made sure that Casso's letters would be deemed inadmissible evidence and wouldn't be shown to the jury.

The phone call was made, but surprisingly, Eppolito's and Caracappa's lawyers did not show up. Instead, they sent associates, including Betinna Schein. Turns out, nine years before this trial, Betinna Schein was the defense attorney for a man named Vic Orena during the Colombo Family War trials wherin Lin DeVecchio was accused of being a corrupt FBI agent leaking information which lead to four murders to mobster Gregory Scarpa, Sr who had killed so many people he was nicknamed "The Grim Reaper". Schein knew everything about Lin DeVecchio's alleged corruption and cooperation with the mob. However, inexplicably during the rest of the trial, she never asked Casso if he knew DeVecchio or Scarpa, Sr. The phone conversation is covered more thoroughly in our third episode.

So, who were the bad guys and who had alternative reasons for impugning the integrity of Casso's testimony?
